Family Law Mediation is a process where an approved third party will listen to the arguments of both parties involved and assist in the negotiation process to help resolve points of contention in a divorce or other family law issue. If issues cannot be resolved, the mediator will make a report and provide his or her recommendations to the family court judge. It is important to note that this report will include the observations of the mediator, and impressions as to which party, if at all, was willing to make an honest effort to resolve the issues at hand, and which party did not embrace the mediation process to resolve areas of dispute.
Typically each party will have an attorney representing his or her interests, rights, and goals in a divorce or other family law dispute. Entering into mediation may be voluntary or ordered by the court. It is not uncommon for an unsuccessful mediation to be ordered back into mediation to make further attempts to resolve divorce and other family law disputes.
While mediation is a valuable tool in resolving areas of disputes in a divorce or other family law case, if the mediation process is not successful, the resolutions of remaining areas of contention are left in the hands of the family law court judge to make rulings on these issues for you.
While in the family law mediation process, it does not mean you cannot aggressively seek your legal needs and goals. It does mean your interest and goals may be best served with the assistance of legal counsel that will provide a strong voice of reason to present your arguments, and advise you on strategies that may best serve your needs, while still aggressively fighting to reach a successful resolution to areas of dispute on your behalf.
It is important to note that while the judge is not present, he or she is watching the proceedings through the eyes of the mediator. Understanding this may go a long way with the court if you are effectively represented in the mediation process.
